1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Floor Cleaner Fred ("Company," "we," "us," or "our") concerning your use of our carpet and floor cleaning services. By booking, scheduling, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Offered

Floor Cleaner Fred provides professional carpet and floor cleaning services including, but not limited to:

  • Residential carpet cleaning
  • Commercial carpet cleaning
  • Hardwood floor cleaning and restoration
  • Tile and grout cleaning
  • Area rug cleaning
  • Upholstery cleaning
  • Pet stain and odor removal

Specific services will be outlined in your service agreement or quote.

3. Service Area

Our services are primarily provided in San Diego, California, and surrounding areas. Service availability may vary based on location. We reserve the right to decline service to areas outside our standard service area or to charge additional fees for extended travel.

4. Booking and Scheduling

Services may be booked through our website, phone, email, or online booking system. When you book a service:

  • You must provide accurate and complete information about your cleaning needs
  • Appointment times are estimates and may vary based on traffic, previous job completion, and other factors
  • We will provide you with an estimated arrival window
  • You will receive confirmation of your appointment via email, text, or phone

5. Pricing and Payment Terms

5.1 Pricing

  • Pricing is based on factors including square footage, type of flooring, condition of surfaces, and specific services requested
  • Quotes provided are estimates and may be adjusted based on actual conditions found on-site
  • Additional charges may apply for heavily soiled areas, pet stains, furniture moving, or services beyond the original scope
  • All prices are subject to change without notice, but confirmed quotes will be honored for 30 days

5.2 Payment

  • Payment is due upon completion of services unless otherwise arranged
  • We accept cash, credit cards, debit cards, and electronic payments
  • A deposit may be required for large commercial jobs
  • Late payments may incur a fee of 1.5% per month (18% annually) or the maximum allowed by law
  • Returned checks will be subject to a $35 fee plus any bank charges

6. Cancellation and Rescheduling Policy

6.1 Customer Cancellations

  • 24+ Hours Notice: Full refund or free rescheduling with no penalty
  • Less than 24 Hours Notice: May be subject to a cancellation fee of up to 50% of the service cost
  • Same-Day Cancellation or No-Show: Full service charge may apply

6.2 Company Cancellations

We reserve the right to cancel or reschedule appointments due to:

  • Severe weather conditions
  • Equipment failure or emergency
  • Staff illness or unavailability

In such cases, we will notify you as soon as possible and work to reschedule at your convenience with no penalty.

7. Property Access and Preparation

7.1 Customer Responsibilities

Prior to our arrival, you agree to:

  • Provide clear access to all areas to be cleaned
  • Remove fragile items, valuables, and personal belongings from the work area
  • Secure pets in a safe location away from the work area
  • Inform us of any special concerns, including delicate materials, stains, or health sensitivities
  • Ensure someone 18 years or older is present during service
  • Provide adequate utilities including water and electricity

7.2 Furniture Moving

  • We will move light furniture such as chairs, end tables, and small items at no additional charge
  • Heavy furniture (sofas, beds, entertainment centers) will be cleaned in place unless furniture moving service is specifically requested and agreed upon
  • We are not responsible for moving electronics, collectibles, or delicate items

8. Service Guarantees and Warranties

8.1 Satisfaction Guarantee

We stand behind our work and offer a satisfaction guarantee. If you are not completely satisfied with our service, you must notify us within 48 hours of service completion. We will return to re-clean the affected areas at no additional charge.

8.2 Limitations

While we strive for excellent results, we cannot guarantee:

  • Complete removal of all stains, especially those that have set for extended periods
  • Color restoration of faded or sun-damaged materials
  • Repair of pre-existing damage to flooring or upholstery
  • Results on surfaces that have not been properly maintained or have exceeded their useful life

9. Liability and Limitations

9.1 Company Liability

Floor Cleaner Fred maintains general liability insurance. Our liability is limited to:

  • Direct damages caused by our negligence during service delivery
  • Maximum liability not exceeding the amount paid for the specific service
  • Claims must be reported within 48 hours of service completion

9.2 Exclusions

We are not liable for:

  • Pre-existing damage, wear and tear, or manufacturing defects
  • Damage resulting from improper maintenance or prior cleaning attempts
  • Color loss or bleeding due to fabric instability
  • Shrinkage of natural fibers
  • Seam separations or delamination in carpets
  • Furniture stains, indentations, or rust marks
  • Items not properly secured or removed from work areas
  • Consequential or indirect damages including lost time, inconvenience, or commercial loss

9.3 Customer Liability

You agree to indemnify and hold Floor Cleaner Fred harmless from any claims arising from:

  • Failure to disclose material information about the property or cleaning requirements
  • Unsafe conditions on your property
  • Damage caused by pets
  • Third-party claims related to the service location

10. Health and Safety

  • We use professional-grade, EPA-approved cleaning solutions
  • Eco-friendly and hypoallergenic options are available upon request
  • Customers with chemical sensitivities should inform us prior to service
  • After cleaning, we recommend allowing adequate ventilation and drying time before heavy use
  • Walking on damp carpets should be minimized for 6-12 hours

11. Dispute Resolution

11.1 Initial Resolution

11.2 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally.

11.3 Arbitration and Governing Law

Any disputes not resolved through mediation shall be settled by binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association. These Terms shall be governed by the laws of the State of California.

12. Privacy and Data Protection

Your privacy is important to us. Collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for detailed information.

13. Photography and Marketing

Unless you opt out, you grant Floor Cleaner Fred permission to photograph the work area before and after service for quality control, training, and marketing purposes. No identifying personal information will be shared without your explicit consent.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. Material changes will be communicated via email to customers with scheduled appointments.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreement or quote, constitute the entire agreement between you and Floor Cleaner Fred regarding our services and supersede all prior agreements, understandings, and communications.
